DOUBLE K QUARTER HORSES, LLC
BOARDING CONTRACT
This contract is entered into on _______________ (date) between Double K Quarter Horses, LLC (Barn) and ________________________________ (Owner), and covers boarding, use of facilities, and all activities at Misty Hill Farms, 205 Reibold Road, Renfrew PA. Barn and Owner mutually agree to the following:
1. FEES
Board is currently $ 320 for inside stall, per horse, per month. A heat surcharge of $10, per month, per horse, will be imposed in the winter months (generally Dec – March) when the furnace has been turned on. This applies to the Main Barn only. Owners will be given 30 days written notice for any rate increases. Increases will be made at the discretion of the Barn Manager. There may be additional charges imposed for special services (i.e. medications, blanketing, etc.). Please see current fee schedule on bulletin board. Owner will be notified prior to rendering of service.
Included in board fees:
a) Unlimited and exclusive use of one Stall.
b) Daily turn-out / turn-in; All horses will be turned out as weather permits in group turnout. Barn Manager will determine turnout of horses and pasture assignment as necessary. Any concerns regarding turnout should be brought to the attention of the Barn Manager and accommodations will be made if possible.
c) Two feedings per day, oats as required and up to 4 flakes of hay per day; Any special feed (i.e., sweet feed / pelleted feed) or supplements will be provided by Owner. Any known feed allergies should be stated on attached sheet.
Grass / alfalfa / timothy hay is available at most times. Type of hay fed will be at the discretion of Barn Manager. Any adjustments to feed amount depending on condition / size / weight of horse will be at the discretion of the Barn Manager (i.e., small ponies, overweight horses, or “easy-keepers” not requiring 4 flakes of hay per day to maintain a healthy weight will not receive 4 flakes per day.) If Owner wishes any changes be made to feed or supplements, changes are to be discussed with Barn Manager and written notice of feed change should be posted on board in feed room.
Additional hay above amount included can be arranged at additional cost. If Owner wishes to supply their own additional hay or grain, Barn Personnel will feed additional portions at designated AM or PM feeding times. NO ONE OTHER THAN BARN PERSONNEL SHOULD BE GIVING HORSES HAY OR GRAIN OF ANY KIND AT ANY TIME.
d) Feeding of Owner-supplied supplements / medications; Any supplements / medications should be prepared in containers and marked with horse’s name and if for AM or PM feeding.

LATE FEES / DELIQUENT ACCOUNTS
Board is due on the first each month. If you have additional fees for other services rendered, they invoiced will be due the first of each month for that month, payable to Double K Quarter Horses, LLC. If Board is unpaid by the 10th of the month, Owner is subject to a $10 per day, per horse late fee.
No horses may be removed from the premises when an account is delinquent. In the event of the Owner’s account more than 60 days delinquent and repayment terms have not been arranged to the satisfaction of the Barn Manager, Owner hereby agrees that, under these conditions, Owner will turn over all legal papers on the horse properly signed. Owner is put on notice that Barn reserves the right without process of law to liquidate the Owner’s assets, including horses remaining on the property, until the amount of said indebtedness is discharged. In the event that sale does not secure a price sufficient to pay costs and charges, the Owner shall be liable for the difference. If legal action is taken for collection of this account, Owner agrees to pay all legal fees, costs, and other related expenses, for which a minimum of $250.00 will be accessed.
3. ROUTINE VETERINARY CARE AND FARRIER SERVICES
Barn Manager is responsible for scheduling all immunizations and farrier services for horse(s) as is reasonably necessary at Owner’s expense. Any vet / farrier / dental appointments that are not part of the regular schedule should be noted on Barn Tracker Calender in aisleway as well as discussed with Kelley. Should you not be available to meet the farrier or veterinarian and they require assistance with your horse or you request Barn Personnel to be present, a handling fee will be charged based on time spent. In the event that Owner does not keep vaccinations and shoeing up to date, Barn is authorized to arrange for such treatment, but not obligated to do so, and such expense shall be the obligation of Owner. Any fees incurred for such services rendered will be added to next month’s board.
4.
WORMING AND VACCINATIONS
A regular worming schedule has been established by the Barn Manager. Wormer will be provided for the Owner by Barn Manager (if desired) to dispense when worming is due and cost will be added to next month’s board. In the event that Owner does not elect to the above option or maintain their own regular worming schedule, Barn is authorized to arrange for such treatment, but not obligated to do so, and such expense shall be the obligation of Owner. Any fees incurred for such services rendered will be added to next month’s board.
5. EMERGENCY CARE
If medical treatment is needed, Barn Personnel will attempt to contact Owner and the Owner will have the primary responsibility in determining the desired course of action. Should Owner not be available, Emergency Contact specified on Application will be contacted. Owner agrees to notify Barn in writing of any and all changes of addresses, emergency telephone numbers, itineraries or other information reasonably necessary to contact Owner in the event of an emergency.
In the event that both the Owner or Emergency Contact is unavailable, Barn Manager has the authority to secure emergency veterinary care, farrier care, transportation, and other services. Every attempt will be made to contact the vet referenced on Application. If we are unable to contact your vet, our Barn vet, HARMONY EQUINE, Dr. Jane Kennedy, will be contacted for medical services. All costs of such care incurred shall be paid by Owner within fifteen (15) days from the date Owner receives notice thereof, or Barn is authorized, as Owner’s agent, to arrange direct billing to Owner.
Owner hereby agrees to bear financial responsibility for emergency care for the horse up to the amount of _________________________________(specify, in dollars). If it is the opinion of the veterinary professional on hand that medical care will exceed the specified amount, or that euthanasia is the most humane treatment, Owner authorizes Barn to humanely euthanize horse. 6. DAMAGES TO BARN PROPERTY
Owner will be financially responsible for all damage Owner’s horse inflicts on Barn facility.
7. PROPERTY IN STORAGE ON BARN’S PREMISES
Owner may store certain tack and equipment on the Barn premises at no additional charge to Owner. Trailers are permitted as space allows on a first come – first serve basis. It is understood by Owner that Barn shall not be responsible for theft, loss, damage, or disappearance of any tack, equipment, vehicles, trailers, or other property stored at Barn, as same is stored at the Owner’s risk.
8. HOLD HARMLESS AGREEMENT / RISK OF LOSS / STANDARD OF CARE
While every effort is made to maintain a safe facility for you and your horse, the Owner is responsible for the ultimate health and well being of his / her horse(s), personal property, as well as his / her own safety while on the premises.
During the time that the horse(s) is
/ are in custody of Barn, Barn shall not be liable for any sickness, disease,
estray, theft, death or injury which may be suffered by the horse(s) or any
other cause of action, whatsoever, arising out of or being connected in any way
with the boarding of said horse(s), except in the event of negligence on the
part of the Barn, its agents, and / or employees. This includes, but is not limited to, any
personal injury or disability to the Owner, or Owner’s guest, received on the
Barn’s premises. You (and your guests) assume the
risk of equine activities pursuant to
The Owner fully understands that Barn does not carry any insurance on any horse(s) not owned by it for boarding or any other purposes, whether public liability, accidental injury, theft or equine mortality insurance, and that all risks connected with boarding or for any other reason for which the horse(s) in the possession of, and on the premises of Barn, are to be borne by the Owner. Barn strongly recommends equine mortality insurance be obtained applicable to Owner’s horse(s).
The standard of care applicable to Barn is that of ordinary care of a prudent horse owner and not as a compensated bailee. In no event shall Barn be held liable to Owner for equine death or injury in an amount in excess of Five Thousand Dollars ($5,000.00) per horse. Owner agrees to obtain equine insurance for any horse(s) valued in excess of Five Thousand Dollars ($5,000.00) at Owner’s expense, or forego any claim for amounts in excess of Five Thousand Dollars ($5,000.00). Owner agrees to disclose this entire agreement to Owner’s insurance company and provide stable with the Company’s name, address, and policy number. Failure to disclose insurance information shall be at Owner’s risk.
10. TERMINATION OF CONTRACT
Barn Manager reserves the right to notify the Owner within fifteen (15) days of horse’s arrival if horse, in Manager’s opinion, is deemed dangerous or undesirable for a boarding stable. In such case, Owner is responsible for removing the horse within seven (7) days and for all fees incurred during the horse’s stay. After all fees have been paid, this contract is concluded.
Either party may terminate this agreement at any time by written notice. Owner agrees to give Barn Manager thirty days written notice to terminate this agreement. Owner cannot assign this agreement unless Barn Manager agrees in writing. If Owner leaves before thirty days notice has expired, prorated board will not be refunded.
Failure to observe the policies
set forth in above contract will result in a warning, and ultimately eviction
if policies continue to be ignored.
Thirty days written notice of eviction will be given.
Barn Manager have the authority to enforce or change barn policies as seen fit. These policies have been set forth to support the good of all boarders and Barn Manager. We appreciate your understanding in any policy changes and ask that everyone cooperate in make the Barn run smoothly.
